Overview
The Yacht Engaged in Trade (YET) regime allows privately registered yachts to carry out a limited and strictly regulated commercial activity, charters, within defined windows from and in certain Mediterranean’s countries including France and Monaco while remaining under private ownership and private registration.
YET offers owners operational flexibility and the ability to partially offset running costs, but it is not a simplified charter regime. Successful and sustainable YET operations require precise alignment between:
- Ownership and control structures
- Flag state registration and commercial operational status
- VAT and customs treatment
- Yacht, Crew, Charter documentation and insurance coverage
- Ongoing administrative and evidentiary compliance

1. Ownership Structuring and Governance
- Advising on and structuring the ownership vehicle appropriate for dual private–commercial use under YET.
- Assessing control, beneficial ownership and governance to ensure compatibility with YET, VAT and flag-state expectations.
- Advising on jurisdictional choices, corporate law constraints and substance considerations.
- Acting, where required, as administrator and corporate secretary of the owning entity, ensuring governance continuity and documentary coherence.
- Advising on flag registry selection compatible with YET operations.
- Coordinating applications for the Registration Certificate(s) and other flag-state authorisations required for YET activity.
- Ensuring alignment between flag requirements, class surveys, safety certification and operational documentation.

- Ensuring consistency between YET charter windows, charter contracts, customs status (Temporary Admission where applicable) and fiscal filings.
- Acting as the central coordination point with local VAT agents and customs intermediaries in Monaco, France and relevant EU ports, either directly or through appointed external advisers
- Supporting the evidentiary file required to demonstrate that YET activity remains limited, compliant and ancillary to private use.
- Advising on the use and adaptation of charterparty documentation suitable for YET charters.
- Coordinating with brokers, insurers, managers and legal advisers to ensure alignment of warranties, liabilities and disclosure obligations.
- Ensuring that insurance coverage appropriately reflects temporary commercial exposure without prejudicing private policies.
- Establishing and maintaining the YET charter compliance file, including supporting contractual and operational records.
- Maintaining the YET documentation file for each season, including log entries, certifications, charter records and supporting evidence.
- Coordinating renewals of YET permissions, flag-state filings and associated fiscal or administrative requirements.
- Acting as a central point of contact between owners, captains, managers, lawyers, insurers and tax agents to ensure consistency across all stakeholders.
- Providing ongoing oversight to help prevent regulatory drift as the yacht’s usage, ownership or operational profile evolves.
- Integrated corporate, fiduciary and yacht administration expertise, tailored to UHNW ownership structures.
- Proven experience supporting complex dual-use yacht operations under YET and comparable regimes.
- Independent from brokers, managers and technical providers, ensuring objective oversight and clear governance.
- Long-established presence in Monaco, with deep practical knowledge of the local YET, VAT and customs environment.
